Welcome to Penyela. By creating an account or using the application, you agree to be bound by these Terms of Use. If you do not agree, do not use the application.

1. Nature of the Service

Penyela is a sports prediction application for entertainment purposes only. There is no real money involved, no gambling, and no monetary prizes. Scores, rankings, and leaderboards are purely indicative and have no economic value. Penyela is not a gambling or betting service.

2. Eligibility

You must be at least 13 years old to create an account and use Penyela. By using the app, you confirm that you meet this age requirement. If you are under 18, you should review these terms with a parent or guardian.

3. User Accounts

You need to create an account via Google Sign-In or Apple Sign-In to use Penyela.
You are responsible for maintaining the security of your account.
You may not create multiple accounts to manipulate rankings or circumvent limits.
We reserve the right to suspend or terminate accounts that violate these terms.

4. User Conduct

You agree not to:

Use the app for any illegal activity, including real-money gambling
Use bots, scrapers, or automated tools to interact with the service
Create offensive, discriminatory, or inappropriate usernames or content
Attempt to manipulate scores, rankings, or predictions
Interfere with or disrupt the service or servers
Reverse-engineer, decompile, or attempt to extract source code

5. Intellectual Property

Logos, badges, and names of clubs, competitions, and sports leagues displayed in the application are the property of their respective owners. Penyela does not claim any rights over these elements. Images are obtained through public sports data APIs and are used solely for informational and visual identification purposes.

The Penyela brand, logo, design, and application code are owned by Penyela and protected by intellectual property laws.

6. Sports Data

Results, standings, and statistics are obtained from external providers (API-Sports, FIBA, MotoGP). Penyela does not guarantee the accuracy, completeness, or timeliness of this data. We are not liable for incorrect predictions or outcomes based on this data.

7. Subscriptions and In-App Purchases

Penyela offers optional subscription plans (Predictor, Plus, Pro, Community, Creator, Audience).
Subscriptions are billed through Apple App Store or Google Play Store.
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period.
You can manage or cancel your subscription at any time from your device settings (iOS: Settings > Apple ID > Subscriptions; Android: Google Play > Subscriptions).
Refunds are handled by Apple or Google according to their respective policies.
We reserve the right to change subscription prices with prior notice. Price changes will not affect the current billing period.
Downgrading a plan may result in reduced features (e.g., fewer pools, fewer members per pool).

8. Content and Predictions

Predictions you make are your own. By submitting predictions, you grant Penyela a non-exclusive license to use this data for rankings, statistics, and service improvement. Your predictions may be visible to other members of your pools.

9. Limitation of Liability

Penyela is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or available at all times.

To the maximum extent permitted by law, Penyela shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the application.

10. Indemnification

You agree to indemnify and hold harmless Penyela, its owners, and affiliates from any claims, damages, or expenses arising from your use of the application or violation of these terms.

11. Account Deletion

You can delete your account and all associated data at any time from Profile > Settings > Delete Account. All data will be permanently removed within 30 days. Active subscriptions must be cancelled separately through your device settings.

12. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.

13. Governing Law

These terms are governed by the laws of Spain. Any disputes shall be resolved in the courts of Barcelona, Spain.

14. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Changes to These Terms

We may update these Terms of Use from time to time. We will notify you of significant changes through the application. Continued use of Penyela after changes constitutes acceptance of the updated terms.
